Mass Tort Litigation

When a large number of people have been affected by an unsafe drug or a defective product, a mass tort lawsuit is an effective way to seek justice for those who have been harmed.

A mass tort is a civil action that arises when many plaintiffs sustain similar injuries as a result of the same defendant’s actions. In these cases, the court may hear consolidated claims in order to speed up the litigation process and ensure fairness to all parties involved.

If you’ve been injured as a result of someone else’s negligence, you may be entitled to compensation. However, pursuing a mass tort claim can be a complex and daunting task. An experienced mass tort attorney will be able to guide you through the legal process, help you gather evidence, and represent you in court.

Some common types of mass tort cases include:

  • Class action lawsuits
  • Consumer protection claims
  • Product liability claims
  • Environmental disasters

Mass tort cases often involve serious injuries, such as:

  • Burns
  • Amputations
  • Spinal cord injuries
  • Brain injuries
  • Wrongful death
  • Serious illnesses

How Long Do I Have to
File a Mass Tort Claim?

The statute of limitations is the deadline for filing a lawsuit. If you miss the deadline, you will be barred from recovering damages. The statute of limitations varies from state to state, so it’s important to consult with an attorney as soon as possible.

Some recent mass tort cases include:

  • Johnson & Johnson Talcum Powder Cancer Litigation: In 2016, a jury ordered Johnson & Johnson to pay $72 million to the family of a woman who died of ovarian cancer. The plaintiff claimed that she developed cancer after using the company’s talcum powder for over 35 years.
  • 3M Bair Hugger Warming Blanket Litigation: In 2017, a jury ordered 3M to pay $9.1 million to a man who developed a serious infection after undergoing surgery with a Bair Hugger warming blanket. The plaintiff claimed that the device caused him to develop a deadly bacteria.
  • Roundup Weed Killer Litigation: In 2018, a jury ordered Monsanto (now owned by Bayer) to pay $289 million to a man who developed cancer after using the company’s Roundup weed killer for over 30 years. The plaintiff claimed that the active ingredient in Roundup, glyphosate, caused his cancer.
Mass Torts vs. Class Actions

Both mass torts and class actions include a large number of people who have been harmed by a negligent party. They differ from one another, however, in how the plaintiffs are treated.

  • Class Actions: In a class action, all claims are part of a group that must prove wrongdoing, and participants are collectively represented. Everyone in the class has suffered the same injury or loss. A class action lawsuit, for example, may involve several people who have been affected by a data breach.
  • Mass Torts: Each member of a group has an individual claim in a mass tort. Participants frequently sustain similar injuries, but the amount of the damages is determined on an individual basis. In general, mass torts result in higher settlements and verdicts than class actions.
Benefits of Mass Torts

Mass torts have become a prevalent legal instrument for the victims of large companies and governments. By grouping your claim with similar claims, you can do the following:

  • Streamline the judicial procedure.
  • Ensure that all relevant arguments are used in every instance.
  • Establish the greatest case for compensation by highlighting the extensive adverse impacts of the product.
  • Maximize your chances of recovering equitable compensation.
  • Contribute to a change that will prevent future injuries.
Types of Damages Available

Due to the fact that each case is reviewed separately, the damages awarded to plaintiffs can vary. Depending on the nature of your losses, a successful case may help you recover the following expenses:

  • Emotional stress
  • Pain and suffering
  • Reduced earning potential
  • Temporary or long-term disability
  • Lost income due to absences from work
  • Past and future medical expenses (e.g., hospital stays, medication, physical therapy, surgery, and rehabilitation)
